Terms and conditions for using the Tojaz platform. Welcome to Tojaz, a Saudi digital platform that brings services, needs, and opportunities together in one place, aiming to make it easier for clients to reach service providers and to help providers reach new clients and suitable opportunities and projects.

Tojaz offers a wide range of digital sections and services, including government and general services, private services, Tojaz Marketplace, Tojaz Opportunities, jobs, businesses and establishments, human resources and recruitment, real estate, vehicles, online stores, education and training, projects and contracts, and other sections and services that may be added or developed in the future.

By using, registering with, or accessing the Tojaz app or website, you acknowledge that you have read and understood these terms and conditions and agree to be bound by them, as well as the policies and instructions related to using the platform.

If you do not agree to any of these terms and conditions, please do not use the platform or register on it.

1.Definitions

Tojaz / the Platform: the Tojaz app and website and all related systems, interfaces, and digital services.
User: any natural or legal person who accesses, registers with, or uses the platform.
Client (service seeker): the user who searches for or requests a service, or posts a need, ad, opportunity, or content within the platform's available sections.
Service provider: the natural or legal person, including individuals, establishments, and companies, who offers or provides a service through the platform in accordance with the approved requirements.
Service: any service, work, product, opportunity, or benefit offered, requested, or provided through the platform.
Order: any order created by the client to obtain a service, product, work, opportunity, or other available service.
Public order: an order posted through the platform so that suitable service providers can view it and submit price quotes for it.
Price quote: the offer submitted by the service provider to the client, including the price, duration, execution details, or related terms.
Agreement: what is agreed between the client and the service provider regarding the service, price, execution duration, or any other details.
Account: the user's electronic account.
Dashboard: the interface that enables the user to manage their account, orders, services, price quotes, and other features available to them.
Content: all text, images, videos, files, ads, offers, data, ratings, and any material the user adds or publishes on the platform.
Sections: all sections and services available on the Tojaz platform, including general and specialized sections.
Registered bank account: the bank account the service provider registers and approves on the platform to receive their dues.
Terms and Conditions: this document and any policies, controls, or instructions related to using the platform.

2.Scope of Platform Use

Tojaz provides a range of digital services, sections, and features that vary depending on the account type and section used.
The client can search for services and service providers, create orders and public orders, receive and compare price quotes, and communicate with service providers.
The service provider can display their services, receive orders, submit price quotes, communicate with clients, execute services, and manage their business through the platform.
A registered user may, according to the permissions available to them, create and publish orders, ads, offers, opportunities, and content in the appropriate sections.
The user must use the platform for lawful purposes and in a manner that does not violate the regulations and laws in force in the Kingdom of Saudi Arabia.
The user must ensure that all data, information, and documents they provide are accurate, precise, and up to date.
Using the platform for impersonation, using forged documents, engaging in fraud, or harming the platform or its users is prohibited.
Bypassing the platform's technical systems, permissions, or protection measures is prohibited.
Tojaz may delete content, suspend orders, restrict services, or suspend accounts when these terms or the regulations are violated.
Some services or activities may require obtaining licenses, permits, or approvals from the competent authorities, and the user is responsible for obtaining them.
A service provider's registration or the display of their services on the platform does not constitute a guarantee of service quality, the provider's competence, or the outcome of the dealing.
Tojaz may add, modify, develop, or discontinue any service, section, or feature.

3.Registration and Account Creation

An account can be created and the platform used according to the registration methods available in the app or website.
The user must provide accurate and complete information when registering and update it whenever any change occurs.
The user is responsible for keeping their account login data confidential and not sharing it with others.
More than one account may not be created for the purpose of circumventing the platform's policies or restrictions imposed on an account.
An account may not be sold, leased, or transferred, nor may another person's account be used without authorization.
Tojaz may request verification of the user's identity, data, or documents when needed.
A service provider's account may be subject to review or verification before being allowed to carry out certain activities or display their services.
Tojaz may refuse or delay account activation or suspend the use of certain features when needed.
The user must notify Tojaz of any unauthorized use of their account.
The user may request closure of their account according to the available procedures, taking into account existing orders, transactions, and obligations.
Closing an account does not waive obligations or rights that arose before the closure.

4.Provisions for the Client (Service Seeker)

The client has the right to search for services and service providers, create orders, and receive price quotes.
The client must provide a clear and accurate description of their need and supply the service provider with the necessary information.
The client is responsible for the accuracy of the information and documents they provide.
The client may receive several price quotes, compare them, and choose the suitable offer.
Tojaz does not guarantee a specific number of price quotes or the availability of a particular service provider.
Upon accepting a service provider's offer, both parties become bound by the agreed-upon details.
The client must cooperate with the service provider and provide the necessary information or files.
The client is prohibited from posting unlawful, fake, or misleading orders.
The client must deal with service providers respectfully and professionally.
The client has the right to negotiate the service details or price through the available means.
The client has the right to rate the service provider after the service has been carried out.
The client has the right to submit a complaint or report when a problem arises.
Using fake or repeated orders to collect data or cause harm is prohibited.
The client must pay any due amounts or fees.
The client must review the offer, service, price, duration, and terms before accepting.
Tojaz may cancel, restrict, or suspend any order that violates these terms.

5.Provisions for the Service Provider

The service provider has the right to display their services, receive orders, submit price quotes, and carry out services.
Accurate and up-to-date data must be provided, including required licenses and documents.
The service provider is responsible for obtaining the necessary licenses and permits.
A service that requires a license may not be provided without obtaining it.
The service provider must ensure that prices, details, and durations are clear and not misleading.
Suitable orders may be viewed and price quotes submitted for them.
The service provider is responsible for the offer they submit.
The offer must include the basic information related to the price, duration, scope of work, and terms.
Submitting fake or misleading offers, or unlawfully collecting client data, is prohibited.
The provider must carry out the service according to the agreement, deadlines, and quality of work agreed upon.
The provider must communicate with the client professionally and respectfully.
Providing services or posting content that violates the regulations or these terms is prohibited.
The provider must maintain the confidentiality of the client's data.
The provider is responsible for the usage rights of the work and content they display.
Dues are transferred to the registered and approved bank account.
Tojaz's commission amounts to 10% of the transaction value and is deducted from the service provider's dues.
The service provider may not charge the client Tojaz's commission separately.
A withdrawal may only be requested once the withdrawable balance reaches SAR 300 or more.
The service provider has the right to submit a complaint or report.
Tojaz does not guarantee a specific number of clients, orders, or revenue.
Registration does not replace any required legal license.
The service provider must comply with the regulations and laws related to their services.

6.Orders and Price Quotes

The platform enables the client to create orders to obtain services, work, products, or opportunities.
Sufficient and clear details must be provided.
The public order may be posted for suitable service providers.
The service provider can submit a price quote.
The offer must be clear in terms of price, duration, scope of work, and terms.
An offer is not considered a final agreement until it is accepted and the required procedures are completed.
The client has the right to compare offers and choose the most suitable one.
Both parties may negotiate through the available means.
Upon accepting the offer, both parties are bound by the agreed-upon details.
Submitting fake or misleading offers is prohibited.
Tojaz may cancel, hide, or restrict any order or offer that violates these terms.
Circumventing the order system or moving a dealing outside the platform to avoid fees or commissions is prohibited.

7.Services and Published Content

Services and content vary depending on the sections and features available.
The service provider is responsible for the legality of the services they offer and the required licenses.
Content must be clear, accurate, and not misleading.
The user is responsible for the content they publish.
Publishing content that is unlawful, offensive, defamatory, fraudulent, or misleading is prohibited.
Publishing prohibited or unlicensed products or services is prohibited.
Infringing intellectual property rights or privacy is prohibited.
Tojaz may review, remove, hide, or restrict content that violates these terms.
The appearance of content does not mean that Tojaz endorses it or guarantees its accuracy.
Tojaz may use content to the extent necessary to operate the platform, in accordance with the privacy policy and regulations.
Duplicate or fake content, or manipulation of information and ratings, is prohibited.
The user may edit or delete content whenever the feature is available.
Tojaz may organize how content, services, and ads are displayed and ordered.

8.Dealings, Payments, and Fees

Some services or orders may require the client to pay amounts according to the nature of the service and the agreement.
The client must pay through the payment methods available and approved on Tojaz.
The payment mechanism varies depending on the type of service or section used.
The value of the service and any applicable fees or commissions are clarified before completing the transaction, whenever applicable.
The user is responsible for the accuracy of payment and financial data.
The service provider is entitled to the agreed amount after completing the required procedures and requirements.
Tojaz deducts a commission of 10% of the transaction value from the service provider's dues.
The service provider may not charge the client Tojaz's commission or claim it separately.
Dues are transferred, after deducting the commission, to the registered and approved bank account.
A withdrawal may only be requested once the withdrawable balance reaches SAR 300 or more.
The service provider is responsible for the accuracy of their bank account data.
Payment and transfer processes may take a duration that varies depending on the bank or payment provider.
Tojaz is not responsible for delays resulting from causes beyond its control.
Using payment methods unlawfully or for the purpose of fraud or money laundering is prohibited.
Tojaz may suspend a transaction or request additional documents when a violation is suspected.
Tojaz may engage licensed payment service providers or financial entities.
The user must provide the information and documents required for verification.
Circumventing Tojaz's commission or moving dealings outside the platform to avoid fees is prohibited.
The "Guarantee" service is subject to independent terms, conditions, and an operating mechanism.

9.Cancellation, Order Termination, and Refunds

The client may cancel the order before the service begins, according to the order's status and the applicable terms.
After execution begins, cancellation may be subject to terms or fees depending on the nature of the service and the agreement.
Upon accepting the offer, both parties are bound by the agreed-upon details.
The agreement may not be canceled in a way that harms the other party without lawful cause.
If the service provider is unable to perform, they must notify the client.
If the service provider fails to comply, the client has the right to submit a report or complaint.
The client's failure to provide necessary information may affect execution or cancellation.
Refund processes are subject to the nature of the service, the order's status, the payment method, and the announced terms.
Cancellation does not require a refund in all cases.
Fees or amounts due may be deducted before a refund, whenever applicable.
Refunds are processed, when due, through the approved mechanism.
Tojaz may cancel or suspend any order when a violation or unlawful use is found.

10.Disputes and Complaints

The client or the service provider has the right to submit a complaint or report regarding any problem related to the order or service.
The complaint must include clear details, and documents or evidence may be requested.
Both parties must cooperate and provide the required information.
Tojaz seeks to review complaints based on the available information and documents.
Submitting a complaint does not constitute proof of the validity of any party's claim.
Some procedures related to the order under dispute may be suspended when needed.
Submitting forged documents or tampering with evidence is prohibited.
Appropriate actions may be taken regarding the order or account once a violation is established.
Tojaz's handling of a complaint does not prevent any party from exercising their legal rights.

11.Ratings and Reviews

The client may rate the service provider after the service has been carried out.
The rating must be based on a genuine experience.
Using ratings for abuse, defamation, threats, or extortion is prohibited.
Creating fake ratings or using multiple accounts to influence ratings is prohibited.
Tojaz may review, delete, or hide any rating that violates these terms.
Tojaz does not guarantee the accuracy of all opinions and ratings.
Ratings may be used within mechanisms for ranking and displaying service providers.
Offering compensation in exchange for a positive rating, or to influence one, is prohibited.

12.Ads and Promotional Offers

Users, according to the permissions available to them, may post ads, offers, services, and opportunities.
Information, prices, and specifications must be accurate and clear.
The advertiser is responsible for the content of the ad and the obligations arising from it.
Ads must comply with the regulations and laws.
Posting fake or misleading ads, or impersonating others, is prohibited.
Tojaz may review ads and take appropriate action.
Any ad that violates these terms may be refused, edited, deleted, or suspended.
The appearance of an ad does not mean Tojaz endorses the information or guarantees the product or service.
Some ads may require fees or commissions, which are clarified before posting.
Using ads to unlawfully collect data or engage in fraud is prohibited.
The advertiser is responsible for obtaining the required licenses and permits.
Tojaz may suspend an ad when there is a violation or a serious complaint.

13.Specialized Sections on Tojaz

The platform includes specialized sections for displaying and requesting services, products, opportunities, and content.
The sections include government and general services, Tojaz Marketplace, Tojaz Opportunities, jobs, businesses and establishments, human resources and recruitment, real estate, vehicles, online stores, education and training, projects and contracts, and others.
Permissions and posting requirements may vary from one section to another.
The user must comply with the section's requirements and terms.
The user is responsible for any ad, order, offer, or content they post.
Some activities may require a license, permit, or approval.
Displaying a property, vehicle, product, opportunity, or service does not mean that Tojaz owns it or guarantees its accuracy or legality.
Posting inaccurate or misleading information or offers is prohibited.
Tojaz may review, edit, hide, or delete content that violates these terms.
Tojaz may add sections, develop them, or modify or discontinue how they are used.

14.Intellectual Property Rights

All intellectual property rights related to the Tojaz platform, including the name, trademark, logos, designs, interfaces, software, and systems, are owned by Tojaz or its licensed rights holders.
No part of the platform may be copied, reproduced, modified, distributed, or exploited without the rights holder's consent.
The user must respect the intellectual property rights of the platform and of others.
The user is responsible for any content they publish that infringes intellectual property rights.
Tojaz may remove or restrict content when a report or claim related to an intellectual property infringement is received.
Using the platform does not grant the user any right of ownership over Tojaz's trademark, software, or designs.

15.Prohibited Activities and Content

Using the platform for any purpose that violates the regulations and laws is prohibited.
Posting, requesting, or providing any unlawful or prohibited service, product, or content is prohibited.
Fraud, impersonation, forgery, misleading, extortion, or threats are prohibited.
Posting offensive or defamatory content, or content that violates others' privacy, is prohibited.
Posting fake or misleading information, documents, offers, or ads is prohibited.
Using the platform to collect or exploit users' data unlawfully is prohibited.
Attempting to hack, disrupt, or bypass the platform's protection measures is prohibited.
Creating multiple accounts to circumvent the regulations, fees, restrictions, or ratings is prohibited.
Infringing intellectual property rights, trademarks, or privacy is prohibited.
Tojaz may remove violating content or restrict the account associated with it.
The competent authorities may be notified of violating activities whenever required or permitted by law.

16.Account Suspension and Closure

Tojaz may suspend, restrict, or terminate a user's account temporarily or permanently when these terms are violated.
The same action may be taken when fraud or misuse is suspected, or inaccurate data is provided.
An account may be suspended for the purposes of verifying identity, data, documents, or activity.
Services, ads, orders, and content associated with a violating account may be removed or suspended.
The user may request the closure of their account according to the available procedures.
Closing an account does not waive prior obligations or rights.
Tojaz may take the necessary actions to protect the platform and its users after an account is closed, to the extent permitted by law.

17.Tojaz's Liability and Limitation of Liability

Tojaz operates as a digital platform to connect users and provide the available services and features.
Tojaz is not responsible for the quality, suitability, or outcome of any service provided by a service provider, unless Tojaz is a direct party to providing the service or expressly states otherwise.
The user is responsible for the data, information, content, and offers they provide or publish.
Tojaz does not guarantee the platform or all services will remain continuously available without interruption.
Services may be temporarily unavailable due to maintenance, updates, malfunctions, or causes beyond control.
Tojaz is not responsible for delays caused by banks, service providers, communications, external parties, or causes beyond its control.
Tojaz does not guarantee the service provider a specific number of clients, orders, or revenue.
Tojaz does not guarantee the client that their order will be accepted or that a particular service provider will be available.
Tojaz is not responsible for dealings carried out outside the platform in violation of the approved mechanisms.
Tojaz's limitations of liability apply to the extent permitted by the regulations and laws in force in the Kingdom of Saudi Arabia.

18.Privacy and Data Protection

Tojaz handles users' data in accordance with the platform's approved privacy policy and the relevant regulations and laws.
Tojaz may collect the data necessary to create the account, operate services, fulfill orders, verify users, and improve the platform experience.
The user must provide accurate and up-to-date data.
Data necessary to execute the service or transaction may be shared with relevant parties or service providers to the extent necessary and permitted by law.
Tojaz takes appropriate technical and organizational measures to protect data in accordance with the relevant legal requirements.
Tojaz may retain some data for the period required by regulations or for legitimate operational or legal purposes.
The details of collecting, using, retaining data, and the user's rights are subject to what is described in Tojaz's privacy policy.

19.Updates to These Terms and Conditions

Tojaz may amend or update these terms and conditions from time to time.
The updated version of the terms and conditions is published through the platform.
The user's continued use of the platform after amendments are published constitutes acceptance of the updated terms and conditions, unless the regulations or the nature of the amendment require otherwise.
If the user does not agree to the amendments, they must stop using the platform.
Some services may be subject to special terms that are updated independently.

20.Governing Law and Jurisdiction

These terms and conditions are governed by and interpreted in accordance with the regulations and laws in force in the Kingdom of Saudi Arabia.
Tojaz and the user seek to resolve any dispute or disagreement through the available amicable means whenever appropriate.
If a dispute cannot be resolved amicably, jurisdiction lies with the competent authorities in the Kingdom of Saudi Arabia in accordance with the applicable rules of jurisdiction.
No provision in these terms and conditions affects rights that may not be waived or restricted under the regulations.

21.Contact and Support

The user can contact Tojaz through the communication and support channels shown within the app or website.
When contacting support, the user must clarify the problem or request and provide the support team with the necessary information.
Tojaz may request additional information or documents to verify the user's identity or the details of the order or problem.
Support requests and complaints are handled according to the approved procedures and channels.
Tojaz may update the approved communication and support channels and means of contact.
